Howard Rosen is a Partner in the Construction Law group at Peckar & Abramson PC, based in New York, New York. His practice focuses on Construction Law and Litigation – Construction, representing construction companies, developers, and contractors in private project transactions and disputes. He also regularly represents public construction contractors in claims litigated in state and federal courts, as well as in arbitration and mediation. Howard has handled a wide range of complex construction disputes, including arbitrations in which he has served as lead counsel for both claimants and respondents. His experience includes international arbitrations administered by the ICC and ICDR involving infrastructure projects, such as power plant construction, and claims related to scope changes and project delays. He has also utilized mediation to resolve disputes involving design deficiencies and alleged defective construction on high-rise residential and commercial projects. In addition to arbitration and mediation, Howard has significant courtroom experience. He has defended contractors against multi-million-dollar delay and disruption claims in reported state and federal court cases and has pursued recoveries on behalf of contractor clients arising from breach of contract and other construction-related claims. His trial experience includes both jury and nonjury matters involving construction law issues. Throughout his career, Howard has represented large and mid-sized contractors in pursuing claims against City of New York agencies, including the Department of Sanitation, Department of Environmental Protection, and Department of Design and Construction, as well as public authorities such as the Metropolitan Transportation Authority, New York City Transit, New York City Housing Authority, and the School Construction Authority. These matters have involved a wide range of public works projects. He also represents affordable housing developers in matters involving access to adjoining properties and has defended against claims brought by neighboring property owners arising from construction activities. Howard is a former Chairman of the Construction Law Committee of the Association of the Bar of the City of New York. He has organized and chaired numerous continuing legal education programs addressing mediation in the construction industry and New York construction law issues, including the New York Mechanic’s Lien Law and disputes involving adjacent buildings. He previously served as a faculty member at the New York University Real Estate Institute, where he taught Construction Law, and as an Associate Member on the Board of the Building Division of the Associated General Contractors of New York State. He is also a member of the Public Contract Law and Construction Industry sections of the American Bar Association and serves on the American Arbitration Association’s panel of construction arbitrators. Howard is admitted to practice in the State of New York. He earned a Bachelor of Science from Cornell University and a Juris Doctor from New York University School of Law.
