On Remand from the Alabama Supreme Court WISE, Presiding Judge. In accordance with the Alabama Supreme Court’s opinion, see Ex parte Davis, 38 So.3d 706 (Ala.2009), we reverse the trial court’s judgment and remand this case to the trial court for proceedings that are consistent with that opinion. REVERSED AND REMANDED. WELCH, WINDOM, KELLUM, and MAIN, JJ., concur.
