Mark is a Partner in Holman Webb's Insurance practice group in Brisbane and has over 15 years’ experience in insurance litigation.

He has extensive experience in personal injury, property damage claims and public and product liability claims in both Queensland and New South Wales.

Mark’s past experience includes working as a national claims manager with responsibility for a claims portfolio of over 800 claims, giving Mark a unique understanding of the requirements of his insurance clients in regards to both claims handling and reporting.

Relevant Experience

• Defence of public liability, product liability, workers’ compensation. Anti-Discrimination, criminal injury compensation and criminal proceedings.
• Advising an insurer with respect to its duties under both statute and common law relating to a large sale of flood damaged motor vehicles to members of the public.
• Appearing as an advocate in superior courts and Tribunals in Queensland
• Recoveries for a major insurance client, including supervision of motor accident damage claims.
• Providing indemnity advice in regard to liability claims including flood damage claims.
• Providing general indemnity advice on motor, home and business policies.
• Product and Public Liability involving indemnity issues, personal injury and property damage.
• Defending a valuer in a claim by a second tier lender. There were obvious problems with liability but Mark was still able to negotiate a satisfactory settlement by emphasising the problems the Plaintiff had with respect to some aspects of its claim and its failure to mitigate.
• Acting for a valuer in successfully defending a large claim by a bank. Following the disclosure process, Mark had the matter referred to mediation where the claim was settled.
• Defence of claims arising from use of Filshie Clips brought against Queensland public hospitals following failed tubal ligation procedures alleging inappropriate application of Filshie clips and/or failure to provide any or any proper warnings as to the success or otherwise involving the application of Filshie clips.
• Between 1999 and 2002, Mark was an in-house legal advisor for Queensland Department of Health. Mark was intimately involved in the consultation and development of the Queensland Health Indemnity Policy for both employed and Visiting Medical Officers. He also provided general legal advice to the Director-General and Health Minister.
