Pat has provided counsel on large, complex domestic and international construction projects, including coal, gas, and solar power plants, interstate highways, bridges, and vertical construction projects. His work includes preparing and prosecuting complex claims involving extra work, delay, and impact issues, many involving substantial dollar values. He has appeared as lead counsel in state and federal courts, as well as in domestic and international arbitration proceedings. His experience also includes defending against subcontractor claims and claims alleging defective work or project delays asserted by owners and other project participants.

Pat has presented significant Construction Lien Law matters before the New Jersey Supreme Court and has tried one of the most complex cases in the history of the United States General Services Board of Contract Appeals. Through his representation of federal contractors, he has developed substantial familiarity with the Federal Acquisition Regulation (FAR) and its application to construction and infrastructure projects.

Insurance coverage considerations are often critical in defending defective construction and related claims. Pat regularly advises clients on issues involving commercial general liability, professional liability, and subcontractor default insurance policies. His work includes analyzing coverage for construction defect claims, advising on insurance program structure, and addressing cost recovery and disclosure requirements under applicable contract provisions and regulatory frameworks, including FAR cost principles and regulations applicable to federally, state, and locally funded projects.

Recent representative matters include:

  • Represented a design-builder on a State Department of Transportation interstate roadway project valued at more than $1 billion, including the preparation and pursuit of claims against its design consultant, resulting in an arbitration award exceeding $10 million in 2020.
  • Represented an international supplier of turbine and energy generation equipment in connection with claims exceeding $30 million related to alleged late delivery for a large solar-generating facility, successfully defending the claims in an international arbitration seated in New York City in 2020.
  • Represented a multinational joint venture in an international arbitration conducted in Vancouver, British Columbia, involving delay and disruption claims arising from the design and construction of electrical transmission infrastructure in the Canadian Rockies, resulting in an award exceeding $100 million for the design-builder in 2018.
  • Obtained dismissals on behalf of multiple construction industry clients in separate actions brought under the U.S. False Claims Act in the United States District Court for the Southern District of New York in 2018 and 2019.
  • Secured a favorable international arbitration award for an EPC contractor in connection with claims asserted by a supplier relating to a combined-cycle power plant project in Saudi Arabia, in proceedings conducted in New York City and concluded in 2017.
