Will I lose my house and car?

Usually no. Federal and state exemption laws protect equity in your home, vehicle, retirement accounts, and personal property. In Chapter 13, you can keep all your property and pay off arrears through the plan. In Chapter 7, you may need to reaffirm or redeem secured debts to keep collateral.

How long will bankruptcy stay on my credit report?

Chapter 7 stays on your report for 10 years from the filing date; Chapter 13 for 7 years. However, most people see credit scores improve within 12 to 24 months of discharge because their debt-to-income ratio drops dramatically.

Can bankruptcy stop foreclosure?

Yes — the automatic stay immediately halts foreclosure proceedings. In Chapter 13 you can cure the arrears through a 3- to 5-year plan while staying current on the regular monthly mortgage payment.

Will my employer find out?

Bankruptcy is a matter of public court record, but employers are not notified. The exception is Chapter 13 wage-deduction orders, which require the employer to remit a portion of wages to the trustee — your employer learns of the case in that scenario.

Can I keep credit cards after bankruptcy?

Bankruptcy discharges credit cards included in the case. You will need to rebuild credit afterward, typically starting with secured cards and small credit-builder loans. Most filers can qualify for an FHA mortgage 2 years after a Chapter 7 discharge.
