Atty. Samantha Haddon

Samantha is a commercial lawyer who specialises in Government procurement and contracting, equipped with experience providing advice and support throughout all stages of the procurement lifecycle, and is an expert on Commonwealth procurement policies.

Samantha has advised on the procurement of a broad range of capabilities including critical Commonwealth infrastructure, health services, complex ICT and telephony services and panel arrangements (including Whole of Australian Government panel arrangements).

Samantha’s experience includes:

• advising Commonwealth entities on the procurement of a broad range goods and services. This includes preparing approach to market documentation, preparing draft contracts (including complex bespoke arrangements), ensuring compliance with Commonwealth policies and the Commonwealth Procurement Rules, conducting legal risk assessments, developing negotiation plans, conducting negotiations, and advising on contract management activities
• advising Commonwealth entities on the application and implementation of the Government Procurement (Judicial Review) Act 2018 including advising on and assisting with the investigation of complaints
• being a key advisor on a compensation process run by a Commonwealth Department under the Government Procurement (Judicial Review) Act 2018
• providing practical and solution focused procurement remediation advice where procurements are no longer achieving their objectives or progressing in accordance with Commonwealth requirements
• advising on grants administration and management across both high-volume low value and low-volume high value grant programs. This includes advising on the development of grant opportunity guidelines, the assessment of applicant eligibility (including potential fraud) and the negotiation and execution of grant agreements
• providing probity advice and support including ad hoc probity advice on specific issues and acting as probity advisor to programs and procurements
• conducting training on a range of commercial law and procurement matters to a diverse range of audiences including legal and nonlegal and from graduates to SES
• advising on the application of the Public, Governance, Performance, and Accountability Act 2013
• advising on privacy matters, including conducting privacy impact assessments and reviewing privacy policies
• advising on corporate governance matters including company constitutions and directors' duties.
