Do I need a lawyer for an uncontested divorce?
Technically no — most states allow self-represented divorce — but even “uncontested” divorces involve property division, support waivers, and parenting plans that have lifelong consequences. A flat-fee uncontested divorce attorney is usually inexpensive insurance against costly mistakes.
How is child custody decided?
Courts decide custody based on the child’s best interests, considering factors like the parents’ capacity to care for the child, the child’s relationship with each parent, school stability, history of domestic violence or substance abuse, and (in older children) the child’s preferences.
How long does a divorce take?
Uncontested divorces can finalize in 60 to 120 days depending on state waiting periods. Contested divorces typically take 6 to 18 months; high-conflict cases involving custody disputes or business valuation can take longer.
Can child support be modified?
Yes. A material change in circumstances — significant income change, change in custody time, or a child’s changing needs — generally justifies a modification request. You must file a formal motion; informal agreements between parents are unenforceable.
Are prenuptial agreements enforceable?
Generally yes, if they are signed voluntarily, with full financial disclosure from both sides, and reviewed by independent attorneys. Courts will set aside prenups that are unconscionable or signed under coercion.
What is a guardian ad litem?
In contested custody cases, courts often appoint a guardian ad litem (GAL) or attorney for the child — a neutral attorney whose job is to investigate the family situation and report to the court on what they believe serves the child’s best interests.
