Can my wife sign a divorce petition with her maiden name, though the petition uses her married name in the title?

My wife filed in a county which she is not a resident. She also signed with her married name, though the petition is named with her Married name. I am afraid this is turning into a circus already. This is the 2nd divorce she has filed for, and has not completed. I just want this over, yet I am always running in to games she is playing. There are no dual licensed attorneys for her state and my state to assist. Just looking for direction and to be a little smarter this time around. Thank you

She can sign with her maiden name. She can also file in any county. The issue is venue, not jurisdiction. You have the right to file a motion for a change of venue to a different county if the county she filed in does not have venue.
I don't think you have grounds to ask for a dismissal based on this information. You can request she amend the petition to reflect whatever is her legal name at this time.
