If I put my 16 yr old on her dads SSI will he get visitation rights with her?

He has had nothing to do with her the whole 16 yrs. He's never called or anything. I don't receive child support and I'm afraid that if I have her put on his SSI that he will take me to court for visitation. Is she old enough to decide if she wants to see him or not? Mark that she has never seen him her entire life and he has never wanted anything to do with her either.

Placing your daughter on ex’s SSI is not, by itself, enough to empower a court to grant a change in custody. In fact it is not even relevant to the issue of his visitation rights with her. If he tried to get visitation or a change in custody, your daughter’s preference will be given weight by the court because of her age . The fact he has not seen her or been a part of her life is also significant information for the court to deny him visitation rights especially when coupled with the daughter’s preference that she not be forced to spend time with him. If he motions the court for a change of custody or visitation be sure to consult with local family law attorney to direct you in handling the response properly to protect your daughter’s preference and other rights. Ms. Bronson is correct. The issues of SSI and timesharing with a child are exclusive. In deciding timesharing, a judge is going to consider the best interests of the child. Fortunately, because of her age, a judge will take her wishes into consideration. Good luck!
