Son & mother buying house. COS lists those 2 as purchasers but want deed with their spouses also. Do all 4 have to be on COS

No ,any of them can buy the house, the house will be in the mother and son's names in whatever capacity they intend to hold interest in the house. The mother's husband and son's wife, just won't have person interest in the house.

In my opinion all parties should be on the contract since title will be in all names. The title insurance policy will then insure all buyers. Otherwise you may have to do a deed post-sale transferring an interest to the spouses.

I think that all four should be on the contract and a simple "Amendment to Contract" adding the additional two names can be done at any time prior to closing. This way, the title company will insure all parties. The sellers would have to sign the Amendment too, but that should not be a problem for them. If you are buying the house with mortgage financing, your lender may also require that the contract be amended to include all parties.
