In filing an appeal for the Family Court, is it correct that filing an OTSC for a stay is an option if time is of the essence,

? i understand this is the discretion of the Judge.. How common is it for the Appellate to issue a stay for child custody?

I agree that this depends on the facts in the case. You don't provide enough information here for any of us to give our best "guestimate" and this is not an exact science. A lot of times courts won't grant a stay, but there are other times the court will under the right circumstances. It depends on what is going on in your case. It depends on the facts of the case and there is no metric that is available.
