It is hard to say from your brief description but, since your son suffered a serious injury, you should consult with a personal injury lawyer in your area. He or she will be able to go into the matter in more depth.

Contact an attorney immediately. This case involves the conduct of a government employee and The Delaware Tort Act will come into play. You should not further delay. Good luck.

I agree with the prior two answers. Only a detailed conversation with a good personal injury attorney in Delaware will allow you to decide whether or not there is personal injury case here.

From the brief description of the facts you have supplied, my best advice is to consult with a personal injury attorney in your area. There are quite a few considerations that must be determined such as was the rent collector acting as an agent or someone else, did he act intentionally, was your son comparatively negligent, etc. In order to determine the answer to these questions, you will need professional legal advice.
