What does this mean? 1) Hearing on Trustee's Objection to Confirmation of Amended Plan VACATED: Case converted to Ch 7

I was in a Chapter 13 and needed to convert to Ch. 7 because I couldn't adhere to the Chapter 13 in regards to the payments. I paid the money to get the chapter 13 converted to chapter 7. i looked up my file in the public records and wanted to know what VACATED meant in my case. Has my case been converted to Chapter 7 successfully?

Vacated just means cancelled. Your case was converted so anything left on the calender related to the chapter 13 needed to be cancelled. That's all.

Yes, it appears that the court converted your case to a Chapter 7. The Chapter 13 Trustee appears to have objected to your Plan, which the court had set a hearing for. Because the case was converted to Chapter 7, though, the hearing on that objection was cancelled.

It means either you or your attorney filed a motion to modify your Chapter 13 plan, and the Chapter 13 Trustee filed an objection to your motion to modify your plan. The clerk set a hearing on the trustee's motion, and you were sent a notice of that hearing date by the trustee. When you filed the notice of conversion to Chapter 7 with the clerk, any issues that would have been raised concerning your previous motion are now moot, since you converted your case. The court vacated the hearing notice previously generated, and indicated by court order that your case was converted to a Chapter 7 case. You will receive a new 341 hearing notice, which will give you the time and place for your 341 meeting in your Chapter 7 converted case.

The court clerk has a strange way of recording events of the calendar. The pacer record you accessed, maybe the judge's calendar, tells one that a hearing was scheduled but was taken off the calendar since the issue was resolved by the conversion of the case to Chapter 7. That said, there is no way of knowing what "successfully" means to you. There are many things that will need to happen before the case concludes. You will meet with a new trustee and they will determine whether you have sufficient income to do a chapter 13. I would imagine you have an attorney helping you with your case. Most cases are on a flat fee basis. YOu already paid for the lawyer, so why not use them when you have questions. If you are not getting the attention you need from them, then you might need to to step up your demands from them. Good Luck

The word vacated means that the motion has been withdrawn. Like a tenant that vacates an apartment, leaving it empty. Hope this perspective helps!

Based upon that wording, it seems as though your case converted to the chapter 7. Therefore there is no need for the hearing on the Trustee's objection to your amended chapter 13 plan.
