The answer is yes. In some situations you may decided that one person would be better suited to be the "caregiver" and someone else to handle the finances as the Trustee. Be sure and use an attorney in your area to prepare your pet trust.

The correct legal question is easy. Yes, the care giver can be the same as the trustee. The real question is non-legal in nature and is “should” the care giver be the trustee? In most cases, yes. However, if you understand the duty of each you should be able to make the correct decision. The care giver is the one who physically cares for the pet. The trustee is the one who manages the funds inside the trust to allow the care giver to pay for that care. So, if you feel that the care giver will be irresponsible in managing the funds set aside for the pet’s benefit then you need to select someone else as trustee. Have an attorney do the trust for you. There is more to it than meets the eye.
