Property division when current husband is living a double life with another woman and kids.

me and my current spouse have three children and own one house we bought during the marriage we currently have no mortgage and he has a home he had before the marriage. I found out he has been living a double life he has bought a house without my knowledge and it is soley in his name.He has also bought this other woman cars I have found titles too. He thinks that the judge will let him sell our house and he gets to keep the other two homes we share and keep everything what are my rights and could he put me an children on the street while he keeps two homes one with a mistress?

According to Ohio law, you are usually entitled to 50% of the marital assets. Marital assets are defined as those assets obtained by either or both parties through their marital efforts, that is efforts made during their marriage. If he inherited the money he used to buy the cars and the other house or if he was gifted those items, you would probably not be entitled to any portion of them. On the other hand, you are likely entitled to 50% of any assets he bought with money he earned during your marriage. Assuming you retain custody of the children, you should also receive child support. Depending on a number of factors, including the length of your marriage and the amount that each of you earns, you may also be awarded spousal support. You seem to be in a pretty tough situation. You may also be able to make a claim for dissipation of marital assets, if your spouse has been spending a significant amount of "marital money" on this other secret life. Basically, you would want to figure out how much marital money has been spent on this other woman and request to get half of that amount back.
