If this is an emergency situation, you will need to go to the magistrate's office located at in your jurisdiction. They are open 24/7 including holidays. These emergency protective orders are only valid for three days; if the court is closed on the last day, then the order lasts until the end of the first day that the court is open.
You can also go directly to the clerk's office at the court and file for a preliminary protective order. These last up to 15 days or until a hearing for a protective order can be done.
Both the Emergency and Preliminary proactive orders are "ex parte," meaning that the other party does not have to be present for these to be issued. The final protective order, which lasts up to two years at the discretion of the judge, usually requires notice to both parties.
