Hi, I am U.S. citizen living in N.J. and I got married in india last year and I only lived with my wife for 6 days only then I came back here. now after coming back here I found out disturbing things about her and now I seek divorce but she doesn't agree to give me divorce. is there anyway I can file for divorce here in U.S.? I don't want to go back there bcz her family is threatening to harm me.

Yes, you are entitled/eligible to file for divorce right here in the US. You will have difficulties "serving" your estranged, ephemeral wife in India, however. Not to worry - with a good family law attorney at your side, you will be able to convince the judge to allow you to serve wife "by publication", i.e. through one of the "mass publication" outlets listed in the court (which wife will never see or read, and that is fine with you)..

Yes. as long as you lived in NJ for the last year (or six months if you claim is based on adultery) you can file for divorce. Difficulties may well come up on the service of the divorce complaint as it must be done in accordance with the Hague Convention. Our firm has had past problems securing proof of service sufficient to convince a judge. But you will not know until you go through the process. There is also a 4-6 month delay in getting proof of service of the divorce papers upon her, so I would recommend you meet with an experience divorce attorney who has had past filings regarding India.
