i moved into my daughters boyfriends apt when they went to jail so that i could house sit and watch their dog i immediatly informed the landlord and filled out a rental application i have been in the apt for almost two months and the electric is in my name the landlord did not contact me at all about my application yesterday he sent a sherriff to the apt. i recieved a tresspassing citation and was told to leave immediatly

You filled out a rental APPLICATION. So what?
Unless you are named on the lease of the unit you are living in, you are a trespasser.
The electric is in your name - so what? Have you been paying the rent? If not, then it doesn't matter that some of the bills are in your name.
Also, you need to READ the applicable lease. What does it say about breach with respect to length of time away from the property? Many leases have an 'abandonment clause' where he tenant is deemed to have abandoned the property if the tenant is absent from the property for a certain length of time.

Did you pay rent and did the landlord accept it during those two months? If so, I think a contract was formed and you would have 30 days from the date the landlord provided you notice. If weren't paying rent, it's undoubtedly trespassing, and you can be removed immediately.
