How much should an award be for an injury caused by student at NJ public school?

My mom was a teacher at NJ public school, and a student hit her in the head with a chair. She went on disability for couple of years and is now retired. This happened 9 years ago and a lawyer was handling this case for all these years. Now a court wants to give her $8,000. Does this sound right? What can be done?

I am assuming that you are referring to a workers' compensation case? If so, it is difficult to answer your question without more information. In particular, what injuries did she sustain, what was the level of impact, etc. There are too many variables to answer your question with the information you have provided.

There are a lot of factors that go into a personal injury case. The extent of her injuries, her treatment, expenses, the amount and length of her disability payments, any Workers Compensation, the case that was put together by her attorney, experts, witnesses, etc are just some of the factors to consider but not all of them.. You would need to speak to her current attorney about why that is the amount of the award. If you suspect an issue with her attorney or the case, then consulting another attorney who practices personal injury law, employment law, and/or malpractice would be advisable.

I agree with Mr. Minor. As to a Workers Compensation claim, there are too many factors unanswered with the information given. If you are speaking of a claim against the student, there are a number of factors that could impact such a claim, but again insufficient information. Either ask for a meeting with her attorney or ask another attorney to review the file.
