!!What do I do?!! I received a notice to vacate by Tuesday from Sherriffs but I wasn't served!!

2007 we had a son who is now 4 yrs old. In 2009 things got bad and he began abusing me, he bought a house and agreed to put my name on it once we got married which was 2 mos later. Finally October 2011 he was arrested for domestic violence and I was awarded a permanent restraining order and rights and possession of real property. Come January I agree to marriage counseling for he sake of our 4 yr . I decide this isnt working our marriage), he takes me to court for custody and now I just find out Tuesday sheriffs are coming to personally remove me. I wasn't served and didn't receive anything by mail nor was it posted anywhere! Reason? July he put a change of address in my name & forwarded to his P.O. Box. My job since 1994 was lost because My attendance can't be relied on.:-((

See a local attorney landlord tenant TODAY, this morning--do not delay or wait until the afternoon. You have a couple things going on, your post address bits of what may be happening, but its important to address the most immediate issue, the 'removal' as soon as possible today.

From what you described, this is actually a family law issue as it appears the removal is based upon a court order not from a writ of execution. Without seeing something I can't be of more help than that. Was there a Notice to Vacate Posted along with a writ of execution? If so, you can attack the writ ex parte (fancy way of saying omg, i need help right now) and have execution stayed pending so actual court hearing. Until you can determine which court the order is coming from you cannot attack it. Right now the guys with guns are not necessarily your enemy. Somewhere on something they gave you is a case number and from that case number an attorney can figure out what to do. Since you're not sure, I'd recommend a landlord tenant lawyer as they are used to 5 day time frames vs 30 day time frames. But call AND SEE SOMEONE today. Don't take no for an answer, someone is in their office today.
