Can I be fired for filing a workers comp claim?

Direct retaliation for filing a claim is illegal in every state. Indirect pressure (accelerated discipline, hostile assignments, encouraged resignation) is more common and can support a separate retaliation lawsuit. Document everything.

What if I cannot return to my old job?

Workers comp typically pays a permanent partial disability award based on your impairment rating and — in some states — vocational rehabilitation benefits. If you cannot return to any work, you may qualify for permanent total disability and should also apply for Social Security Disability.
