H1B VISA Transfer and Out of Country Travel
Anonymous5 views3 answers
Hi, I am currently on a H1B VISA working for Employer A. I also have another job offer from Employer B.
Employer B hasn't filed the VISA transfer. They will be filing in couple of days. However, I am going out of USA for a month. Is it possible for Employer B to file the transfer when I am out of country.
I am planning to return as an Employee of Employer A. I will join Employer B when I come back. Will their be any issues due to this transfer on my VISA Stamping. I am planning to get VISA stamping based on Employer A. Will there be any issues in transfer if I am out of country?
If you are returning to the United States to work for Employer A, you must enter on an H1-B visa for Employer A. In other words, given the question that you posed, you will not obtain a visa based on Employer B.
If you have any questions about the proper procedure, consult the attorney handling your H1-B visa cases. For a second opinion, consult another immigration attorney.

I would not recommend this. Premium process your H1B transfer and get the new approved H1B in your passport. What does your current attorney recommend?
