Can we file a motion for enforcement of a temporary order, and contempt?

Child Custody 6 views 1 answers
Husband was named joint managing conservator of his son in the temp orders with extended visitation. His son's mother has not followed through with the court ordered classes by the deadline given, has not signed up for the social study and paid the fee(no deadline stated in order), refuses to update the ourfamilywizard website and now refuses to communicate through it which was ordered; can we file for enforcement and contempt on the temporary order? Also she is not supposed to say disparaging remarks to son about my husband but she told him that we live in the ghetto and there is alot of violence so he shouldnt feel safe when he is with us, does that count? We have no proof about the other stuff she says but we do for this.

You should file a motion for clarification and enforcement. You probably won't get anywhere with the enforcement part, but the Judge will put deadlines in place for the social study at least, and you can tell the rest to the Judge at the same time. Evidence is crucial if you expect her to actually be sanctioned or punished.
