My franchisor has terminated my franchise agreement and my landlord will not let me out of my lease that has 20 months remaining

The landlord wants me to sign a voluntary surrender agreement so they can start trying to find a new tenant. I am still expected to pay the rent even though I no longer have a business to collect revenue. How can I deal with my landlord who is in the state of California

Franchise terminations present complex legal issues which need careful analysis. You should immediately consult with a licensed attorney in your state who is experienced in franchise law matters who can advise you as to your rights and obligations.

Unless you franchise termination was improper (in which case you may be able to sue the franchisor for damages for the lease, etc.) or your lease provides a franchise termination will end the lease, you're liable for the lease until the landlord finds another tenant. You should show the termination paperwork and correspondence to a good franchise attorney who can then advise you further. Good luck. Kevin B. Murphy, B.S., M.B.A., J.D.
