I have transferred my 5year supervised probation to north carolina from south carolina becuase i have heard that n.c. Is much more lenient and willing to work with offenders than s.c. I am on probation for drug charges, will i be banned from drinking alcohol. Also, i am vice president of international sales for a machinery company. Will i be able to travel for business?

If you are on supervised probation and you need to leave the state then you must have specific permission. Your lawyer in SC will likely have to go back to the judge in SC to receive permission for you to travel. You want to make sure you have proper permission before you leave lest you subject yourself to a probation violation.

You may wish to see our blog on Supervised Probation: http://northcarolinadwiblog.com/2011/09/02/bill-powers-discusses-travel-during-supervised-probation-in-north-carolina-common-terms-conditions-policies/ Without more information, it's difficult to answer the inquiry in greater detail. A LOT depends upon whether the matter is Supervised vs. Un-Supervised Probation. Normally a "transfer" would denote Supervised. As you will note, the Court may impose certain conditions in addition to those set under the "Normal Terms" of probation. Mecklenburg County has some excellent probation officers and over the years, we've found them to be easy to work with. bill powers charlotte, nc

You may need to speak with a lawyer about having permission to travel written into your judgment. Without that, Supervised Probation generally requires you to stay in the state unless you have specific permission from you Probation Officer. This may mean that you would need to seek permission every time you need to travel. An order that is made part of the judgment can provide blanket permission or at least can set up a system with clear rules about when and under what conditions you will be allowed to travel.
