How do I get my ex-husband’s name off my car title? Final divorce decree awarded it to me, but both our names are on the title.

Both of our names are on the title for the car. When my ex-husband and I got divorced, our final divorce decree awarded the car to me. I need to know how I can remove his name from the title so that the car is mine and mine alone.

I am sorry that you are going through this. The best way is for him to sign the title over to you and for you to retain or re-title the car. Another option is for him to sign a contract of sale over to you, sign the title, and register that way. If this is outside the scope of your divorce attorney or separation agreement's venue, your local registry of motor vehicles or appropriate government agency should have a form or a solution on their website I hope things work out, and take care.

The other lawyer made some good suggestions. If you need help with the paperwork, a lawyer would likely charge a flat fee for drafting a bill of sale and helping you find the right form to take to the DMV.

Depending on what you want to do with the car, the fact that the divorce decree awarded it to you may be enough. In that case, you won’t have to pay anyone any additional money. For instance, if you are going to trade it in for the purchase of another vehicle, make sure you take a certified copy of your final divorce decree with you to the dealership and that will suffice. Alternatively, if you can get your ex-husband to complete a Power of Attorney to Transfer Motor Vehicle, he doesn't need to sign the title. You may be able to find that document online. Good luck.
