I need to fill out an affidavit for non-prosecution. When I wrote my statement the police kept telling me to add more info to it than I felt needed to be as a result my friend was charged with somethings he did do and somethings he didn't. He now is charged with a felony for smething that never occured.
If you have already given a statement to the police you need to make sure that any subsequent statement you give does not indicate that you lied in the initial statement or you could be charged with a crime. You can always hire your own lawyer to help you through this situation
You should consult with an experienced criminal defense lawyer to deciede on the timing of this new statement. You want to avoid the issues Noah mentioned,
gIf you truly, truly exaggerated about what happened, you could face prosecution yourself. Law enforcement gets very frustrated with women who allow themselves to be falsely portrayed as victims of domestic violence or who have "buyer's remorse" after having a lover arrested. Also, you will probably not be believed by anyone and you will lose the ability to have the ear of the prosecutor to influence the result. I would add that whatever really happened, you might also benefit from talking to a counselor experienced with domestic violence issues, to help you unravel how you feel and respond in this relationship. I agree though you absolutely should consult with an attorney before you say anything to anyone. Good luck!
