My husband has been charged with DV second degree assault against me, the police officer filed a complaint not me. Now they wanted me to appear at the trial as a victim. My question is, what if i never get any summon to appear to court until his trial date, could get a bench warrant? I called the state's atty's office, letting them know that im back in our home state, and i'm not going to testify against my husband as i have the marital privilege rights in the state of maryland and this is his first offense.
Generally, if you are not served with a summons, a court doesn’t have the authority to issue a body attachment to secure an appearance. Given your question, I strongly recommend that you retain an attorney to discuss your specific situation. You shouldn’t rely on this “general” opinion about what “typically” happens when the potential impact is that you could be subject to a restraint of your freedom. Moreover, an attorney can help you achieve your goals, whatever they may be, regarding the criminal case and can also explain the potential impact of your decision.
