If I ask a lawyer (who represented me in 2011) for a copy of his file related to my case is he required to give me a copy?

If so, what is a reasonable turnaround time I can request of him? I cannot file my tax return until I receive the information that he should have. Also, what is a reasonable amount for him to charge for this if there is a charge? The file should not be very large at all. Thank you.

You are entitled to a copy of your file but the attorney can delete any notes or work product from the file prior to your copying it. Your retainer agreement may address the issue of obtaining a copy of your file and the charge for such.

If you do not owe the attorney any fees, then he should release the file. If he is owed attorneys' fees, he may be able to assert a charging lien. The average cost for copies is $0.25 per page and depending on how busy the attorneys' practice is and how many staff members he has, it could be done fairly quickly.

1. If you paid the fees due and costs, then you should be able to get a copy of the file. 2. Is the file in the attorney's office still or in storage? If in storage there will likely be a retrieval fee that you will need to pay in addition to the per page copying charges. 3. You will have to pay a per copy charge for each page. If you know specifically what you need, why not just ask for that? 4. Make your request to the attorney in writing, send it certified if you believe you are not getting timely answers, so you can esablish when the request was received. 5. 2-3 weeks should be sufficient time to get your file or, at least, a response. 6. If no response is received, then file a complaint with the local Florida Bar office.
