What happens to the passenger of a stolen vehicle that had no knowledge?

Criminal Defense 11 views 3 answers
My husband has been arrested for being a passenger of a stolen vehicle. He had no knowledge the vehicle was stolen, the driver had a key and claimed it belonged to a family member. The driver is now trying to throw my husband under the bus because he not only has open cases but we've found that he's an illegal alien. We can also prove my husband was not at the scene when the car was stolen. My husband is being charged with grand larceny, yet after a month of holding there is still no indictment number, and his first court date has simply been adjourned to a later date. The lawyer has had no contact and my husband and I are very lost as to what we can do. I am pregnant please give us some info fast. Thankyou.

If he is out of jail, hire an attorney to help. If he is in jail, ask for a meeting w/his attorney and/or supervisor if it"s Legal Aid. Sometimes attorney's adjourn cases to try for the best deal. If your husband doesn't want a plea, he needs to make that clear and put the case into the grand jury and try and beat the case there. Joseph Am Lo Piccolo, Esq. If your husband was simply a passenger and there were no indicia of theft this may be a very defendable case. You should meet with the attorney and discuss the strengths and weaknesses of the prosecution’s case and whether of not you want to fight it or take some sort of plea bargain. Cases get adjourned for any number of reasons, one of which might very well be because the attorney is working on the best way to dispose of the case. This should be something you discuss with the attorney as well.

The first issue is that of custody. Bases on the facts you posted your husband should be out on the street if he has no criminal record. You should speak to his lawyer to get an up to date analysis of his case and if you can't get in touch with his lawyer, find a way to remedy that situation immediately. Good luck.
