Can I get a Restraining order on my Childs Grandparent?
Anonymous7 views2 answers
My Daughter is 1 1/2 years old, My In Law is psycho and has made suggestive remarks of wanting to take my daughter is constantly texting me rude comments shows up unnanounced, and is basically just a nightmare. I don't want her or her abusive husband anywhere near my daughter and i feel they will just do whatever they want. Is there anything I can do to make them legally stay away from me and my daughter? If I get a restraining order on her for me would that protect my daughter or can i get one for my daughter?
You can get a restraining order if it is in the best interest of the child, but before I went to that expense I would tell her that if she comes over unannounced again or sends repeated annoying texts, that you will file a police report for harassment and/or for trespassing; and then when she ignores you and comes over any way or repeatedly send you annoying texts --call the police for harassment and/or for trespassing. If you are not separated from the other parent, you may make your spouse/roommate angry. If you are separated, then the other parent may designate a competent adult to pick up and return the child pursuant to court ordered visitation. If the in-law is not competent, then you may refuse to turn the child over to her. I kind of need more information to answer this question. If you need more information then you may contact me at my office at 210 349 5555.
You may send the in-laws a criminal trespass warning via letter. Send regular mail AND certified. In the letter you will have to designate the address where they must stay away. If they show up again call the police. You can go to the expense of a restraining order as long as it is in the best interest of the child. However try the criminal trespass warning.
