my teen 17 was arrested for having a screw driver in his pocket, unfortunately he said it was for protection. they told me it was a felony, he was suppose to be going to a military school, but they won't take him if he has a felony. Can the felony be reduce to midemeanor?

There is something missing if your son was charged with a felony for possession of screwdriver. The simple answer is yes. A felony charge can potentially be reduced to misdemeanor. That said, I suspect that some undisclosed facts have some bearing on the prosecutors decision. I hope your son has attorney. Feel free to call if you have any questions. I'd be happy to explain things in detail free of charge.

The key is whether it is a 707b offense . It needs to be an alternative felony ie could be charged either way. Hang in there and get the facts to make it a m or dej.

Who is "they"? The police or the prosecutors? In juvenile they do tend to charge the highest crime they can to have the max confinement time over a minor's head for rehabilitation purposes. Also, police for booking purposes put in anything for purposes of bail and confinement but it isn't necessarily what a prosecutor charges someone with. Without knowing which specific charge is actually filed by the prosecutor, couldn't advise with whether it could be reduced to a misdemeanor.
