I have sole custody of my 5 year old son. he has not seen his biological fathe in about 3 years. he does not even remember him. his biological father did not as for visitations and with my fincancial situation and since he never holds a job i didnt bother with the little bit of child support i would have gotten. he has randomly contacted me no more than once a year for maybe a 5 minute conversation. i am getting remarried and my fiance wants to adopt my son. are my exhusband random phone calls enough for him to stop the adoption??

This question is missing certain facts. Is the biological father listed on the birth certificate? Did he sign for paternity? Is he a putative father? You will need to meet with an attorney on this one. Based on the limited information provided, if the biological father is known by records, he will have to be named in a petition for adoption and given the chance to object or sign-off. Certainly, his abandonment could be difficult to overcome.
