Neighbor's cat came in to my house, attacked my cat, I am bit.

Late in the evening last night I opened my door to get some fresh air. My cat is strictly an indoor cat ( I am so paraniod about him being outside). He is the friendliest, most cuddle loving cat I've had. A neighbor's cat walks inside my house, absolutely uninvited. The moment this cat walked in, they started fighting. My boyfriend tried to break it up by stomping on the ground and shooing the neighbor's cat with his foot. However, no such luck. Worried that it might go on longer and my cat who just had surgery would be seriously injured, I went to grab my cat by his neck to get him and pull him away. He bit me and I ended up going to the hospital. Is my neighbor who owns this cat that walked into my house, attacking my cat, liable for the injuries I recieved due to this cat fight??

I'm sorry to hear about the injuries to your cat. As a cat owner, I can understand your anguish. Your situation poses an interesting question regarding liability of the other cat's owner. There is a whole body of law concerning the liability of dog owners for injuries and damages their dogs cause but there is no comparative body of law pertaining to the liability of cat owners. There are no leash laws that apply to cats and they are free to roam without restriction. If your neighbor is a homeowner or a renter that carries renter's insurance you may make a claim for your injuries and the cost of your cat's vet bills, if any. You could also file a small claims action against your neighbor. However, I have serious doubts about your ability to prove liability. You should contact other attorneys for their opinions. I hope you find a satisfactory answer.

Yes, he is liable for the injuries to you and your cat. Send him a copy of all medical and vet bills and ask for payment by X date. If he does not pay by that date you can file a claim against him in small claims court.

Make sure your girlfriend seeks appropriate medical treamten for any injuries. Make sure your cat goes to the vet for same. Gather the bills and present a demand tot he other cat's owner. If they refuse the demand ask for the name of their homeowner's insurer. If they refuse that request, then file a small claims action and be prepared to show how you come up with your damaegs. You may also have to explaint why the door was open without a screen which allowed the nieghbor's cat to get into your house.

Short answer: YES you neighbor who owns this cat is liable for your injuries. It is a bit unclear what your injuries are - you may need to retain an attorney to help out. If you have Cat Scratch Fever - well then......only Ted Nugent would be able to help......wha?! Best of Luck!
