the mother does not work, does not have a license, drinks. she lives off the child support and lives with her boyfriend and his parents in a two bedroom home in a bad nieghborhood( at least it is compared to ours). the child never wants to go home and sometimes he hits her when she tries to take him and put him in the car or house. he is a boy but he always has scrapes and bruises but that could be just him being a boy, but we could provide more for him education wise and support and we have a stable home we own our own home ..advice?

An award of sole custody is based upon a finding of what is in the "best interest" of the child. Therefore, he has a chance of obtaining sole custody if he can prove that such an order would be in the child's best interest. The first thing is establishing paternity. You didn't say whether he has been established as the legal father or not (not just signed the birth certificate). He should establish a legal father-child relationship as the first step if that has not been done. Then he can deal with the best interest issues. Not working, no drivers license, drinking and bad neighborhood are all considerations - but probably by themselves are insufficient. You need to work with a good family law attorney to get a handle on the particulars of his specific case. Why does she not work? - Is she disabled or lazy, has she been fired? Why does she not drive? - Is it just that she doesn't have a car or has she lost her driving privileges? What could custody to your boyfriend offer the child? What are the derogatory things that the mother will say about your boyfriend? What of those things are true? This is just the start of the questions that need to be asked and pursued in private with his attorney. The attorney should be able to give you some idea as to the cost of seeking custody. Good-luck, I hope things turn out well.
