Difficulty of modifying Joint Parenting Agreement in Kane Couty, IL

Bankruptcy and Debt 4 views 3 answers
Have Joint Parenting Agreement 3 years old in Kane County, IL. Want to go back to change some of the contents. Tax deduction - not mentioned in original, want to add that it should alternate. Visitation schedule - want revised for a later return time (currently 5 pm from when child was an infant). Transportation - want changed from father (me) responsible for all - to 50/50, and a few others. Expect all changes to be contested, since current agreement heavily favors mother across all topics. Is it possible to get this all? Am I wasting my time trying? What kind of legal time/battle could I be facing?

yes it is possible. is it probable? we do not know. first you must mediate these items. put your proposal in writing. send it to her. tell her if she agrees, you will have a court order prepared. if she disagrees, then suggest some mediators to her if you jpa does not name one. if she disagrees with your plan, then you contact the mediator, tell your ex you have done so. send your plan to the mediator in advance. go to the mediation. if it fails, hire a lawyer to file a petition. you have to show a substantial change in circumstances for the exemption. that is really a support reduction to her. the others are best interest issues.

It is possible to make these changes, but the extent of how much time and money it will take depends mainly on whether your ex is agreeable. It's possible to propose an Agreed Order with the changes and negotiate instead of going straight to litigation. Also, your parenting agreement might require that you mediate all proposed changes prior to litigating. Read your agreement and see if there is a provision for mediation. Then talk to an attorney about modifying it.

It is impossible to say online what kind of battle and expense you will or could incur. You need to consult with an attorney who is experienced in family law. Call around. Make an appointment or more than one. We cannot speak for other attorneys' fees or methods. One thing is for sure - you will need to mediate some of these issues if you cannot agree.
