Default Judgment

Business 3 views 1 answers
I am about to move for default judgment against a defendant. Now there is another defendant but he has more time to answer. Can I move for default against the first defendant, and then amend that same motion to move against the second if and when the second does not respond either?

That would be a pain because you would have to prepare two sets of papers, file twice, serve twice, etc. You have 1 year to take a default judgment so why don't you wait for the time to run out on the second defendant and then make one motion seeking a default against both defendant at the same time.
