Can a divorce judge order marriage counseling in a divorce case if one side requests the counseling?

My spouse filed for divorce. My spouse is under extreme stress as she is a top executive with her company. She is also going through a severe bout of menopause, which has caused most of our family issues. I do not believe we should not be getting a divorce. If a divorce judge sees potential for reuniting a couple because of this, can the judge order marriage counseling?

It is not the judge's job to look at potential for reconciliation. Under the situation you describe, the judge can suggest but it is highly unlikely he or she will order counseling. The bottom line is that if one party to the divorce persists in seeking the divorce, it is inevitable. You most certainly can ask for counseling. The best way is to ask though your respective attorneys.

No Judge can order counseling or order a couple to reconcile. A Judge can suggest counseling, but cannot order Marriage Counseling. Do you have an attorney? This is a fairly straightforward question that any experienced Family Law practitioner can handle. You can petition the court to have your wife evaluated. You need to file and be successful on a 215 Petition for a medical examination which could include a Psychological evaluation.

As much as I respect my colleagues, they are all incorrect. Yes, a judge can order reconciliation counseling pursuant to 750 ilcs 5/404. It very seldom happens, but it is possible.
