My husabnd got into some trouble with DUI's about 3 years ago. He has a court date to be discharged from probation next month and was told by DMV that he would get his drver's license back in July of this year. Now DMV is saying he can't have his license back until Aug of next year. Should we try to take it to court?

It is unclear if the conviction was for a 1st time DUI, DUI with priors, or a felony DUI conviction. Typically, on first or second time misdemeanor DUIs, the courts do not get involved with suspensions. In some counties, courts may order court license suspensions on 3rd or more DUIs. If the court did not suspend your husband's license, then it is all DMV. Your husband should find out why his license is suspended. There may be multiple issues or just some type of record snafu at DMV. He should get a H6 printout from DMV so he can see what is holding up his ability to drive. If it turns out to be a simple error with his probation, his lawyer on the DUI case should be able to clear it up if it is court related. If not court related, it could be a difficult process. He should talk to his lawyer who handled his DUI...however, if it was a public defender or he represented himself, he may want to find an experienced DUI lawyer in your area to help clear up the issues.

My colleague is correct. You need to find out why his license is suspended. Get a copy of his DMV record. You will need an attorney to review this
