What do I do when my probation expires?
Anonymous5 views5 answers
I'm currently on formal probation in the state of CA and it is expiring September 18th of this year. Will I automatically be off probation on that day or do I have to do anything like fill paper work out or report back to court? I have complied with all the terms of my probation except the financial part of it. I do make payments to restitution almost every month, but I still owe most of it. Also, since I still owe a restitution will it turn into a civil judgement or what will happen with that? Some POs tell me that I should put myself on calendar to extend probation because if I don't then I fill be facing an arrest warrant and others tell me NOT to do that and just keep paying every month. They say that it will turn into a civil judgement, but to just keep paying and I will be fine
The probation just ends unless the PO /DA asks the court to extend it. There is a limit beyonf=d which the court cannot go without your agreement. Your regular payment is evidence that you are not willfully disobeying a lawfule order. The amount owed after probation ends is a civil judgement.
You PO should be able to advise you. Typically if all the conditions of probation have not been met you should be notified of the violation and given a court date.

Probation does automatically end. It is not likely that the PO would use restitution as a reason to extend your probation, especially if you have been current with your payments.

Most types of probation just end, unless the PO or court try to revoke/accelerate your sentence. Your PO will have the best answer for your situation, since they deal with this all the time. Every court does things differently, so make sure you get this cleared up before September 18,

Paying your fees before September is the best option, but if you cannot possibly do that you need to put yourself on calendar to reques an extension BEORE you risk violation. It's much easier to explain why you may not be able to do something and ask permission for additional time, then to beg for forgiveness about why you didn't.
