You have ten days from the date of sentencing to file motions with the court and thirty days to appeal regarding the DUI. That is separate from the PENNDOT license suspension, which that appeal would also be thirty days from the suspension notification. You have surpassed both by an extremely long period of time. I am sorry to say it, but from what you have provided there appears to be no real avenues of relief. No one can say that for certain without reviewing the case in full, but Pennsylvania is extremely strict when it comes to deadlines. Two to three days late is often a difficult issue to overcome. When years pass by without any action it is that much harder.

I agree with Attorney Doyle, this issue arises in North Carolina all the time. The only option in NC, when a defendant passes the time period is to petition the court and prove it was not the defendant's fault. We must show the attorney representing the defendant was incompetent or failed to advise the defendant correctly. See if you are eligible for a DMV hearing in PA or what you would need to do request a hearing, contact the DMV today to get the ball rolling.
