Can i kick my wife out of the house?
Anonymous8 views4 answers
And what would I be looking at for a settlement? I have wanted a divorce for the past 2 years. I am just not in love, and she pisses me off on a regular basis. She is slowly destroying the house. We have two cars and a house, all in my name. She is not on the title for the house.
She caught me sexting once and that was it. I don't know if she has ever cheated. We have a 2 year old child.
You made a catastrophic mistake in putting your name and email address, and admitting to misconduct, on the public internet (posts here on can easily be found by Google and good lawyers know how to search). You have thus given your wife excellent ammunition for the divorce (this is why suggests you don't post email addresses and names).
You can't just throw out a spouse. Before you make more legal mistakes, hire a good divorce lawyer to represent you and do what he/she suggests. Be aware that house deeds and car titles can be changed, and be aware that there are bigger issues - child support, custody, visitation, insurance, parenting plans, etc.
Good luck.

No, you cannot kick your wife out of the house. To "get her out", you need to file the divorce action, ask for possession of the house, and hope it is granted on a temporary and permanent basis.
It is not possible to tell you what you're "looking at" in terms of settlement based solely on the information you've provided. The distribution of a marital estate is determined only after looking at the ENTIRE marital estate and hearing the arguments of both side regarding how they think it should be divided. For you to get some idea of what may be granted, you need to hire an attorney and let them know much more information than you can (or should) provide in this forum.
If you are ready to terminate your marriage, you should contact a local Family Law Attorney now.
I hope this answers your questions.

Because you are still married you cannot kick your wife out of the home without first filing for divorce and obtaining a court order.
