Fraud by trustee who is trying to rectify mistake

Business 6 views 4 answers
There is an irrevocable trust set up to restore a fraud against me with a financial adviser at a brokerage company. Am I, as beneficiary, entitled to know about it especially since I am the one for whom the trust is set up? No distributions have been given out yet and the trustee is getting trustees fees while keeping me i the dark. What can I do? I have been given no notice of the trust which seems like another breach.

Who set up the trust and how was this done? Was it done as part of a settlement between you and the company? If so, what was your agreement with them? Did you have an attorney? If so, your attorney may be able to help you. There are too many unknowns to truly be helpful to you. I assume you have contacted the trustee and requested whatever information you are seeking? If you have not, I would contact them in writing and request it. James Frederick

I assume you had an attorney in the underlying fraud action. If not, you did a good job on your own in getting a brokerage company to admit fraud. If you had an attorney I would first contact him or her and get their advice. If counsel is not interested in assisting you then I recommend you contact a board-cerfitied civil trial lawyer in the county where you reside. Most lawyers will give you a half hour free consultation.

Simple question for you-if trustee commited fraud against you once and says he has set up a trust to rectify the fraud-but will not share the information with you-HOW DO KNOW AND TRUST ANYTHING IS BEING DONE. Give them a deadline to share information with you-or report the fraud.

Your question suggests that the trustee is the financial advisor who committed fraud against you. That would be an odd situation. Or did you mean to imply that the trustee is now committing fraud by keeping you in the dark? Serve the trustee with a written request for information. If the trustee does not respond by your requested date, contact an attorney.
