We don't have enough facts here. Legal adoption is a very complex matter. Adoptive parents must have legal custody of the child before he/she reaches the age of 15 (at least 2 years prior to that age.) The fact that the child was not lawfully admitted into the country complicates matters even more. Seek to speak to an immigration attorney specializing in adoption matters. With all due respect to my colleagues who practice in other states, the short answer to your question is "yes, you can do an adult adoption of an illegal immigrant under Georgia law." However, if you are doing this as a way to address immigration issues then my colleagues are correct that you need to consult with an immigration attorney. Completing an adult adoption can create a parent-child relationship but it cannot "fix" immigration issues.

What is the purpose of the adoption? As noted above, an adult without legal status may be able to be adopted in your state however the adult will not be able to get immigration benefits through the adoption.
