I'm a first-time offender who's been charged with 1st degree possession with intent to distribute in Bergen County, NJ.

The amount I'm charged with possessing WITD far exceeds the minimum limit for 1st degree marijuana. What are my chances of getting "second degree time for a first degree crime" by pleading out, or of getting accepted into some kind of program like Drug Court, ISP, etc. Are there any viable options for a non-violent 1st degree charge to getting me less than a 10 year (minimum!) sentence? Any successful lines of defense or leverage? I have hired a criminal attorney, but want to get your advice, please.

Your situation requires much more information to properly respond. Over 25 lbs of MJ is always a problem. Drug Court is not available on a first degree. But the guidelines have recently been altered so there is now a better shot. Anytime MJ is involved there is more chances than with harder drugs. A reduction to a second degree puts drug court in play. Sentenced as a 2nd puts 5-10 in the picture. The defenses depends on the facts.

I agree in that your situation is serious enough where you should consult with N attorney in person. I do not have experience with MJ but Mr. Cheser does, and this is necessary for your case.

If you trust your attorney, then follow his/her advice and do not try to second guess with attorneys, who don't know all the facts. If you lack confidence then get another lawyer because ten years is a long time.
