Can Canadian with DUI in Korea enter US to work?
Anonymous5 views3 answers
Last week in Korea, I was charged with DUI (alchohol content = 0.08) during a spot check. I have to pay approximately pay 1,500 USD on fine.
My question is would this incident be connected to my passport, if so, would I be able to receive relevant visa to work in the US?
For your information my step mother is an American who lived with me in Canada since 1987 until I moved to Korea to work in 2003.
Your sincere feedback would be appreciated
Thank you
"Connected to my passport"? No
Will it be asked on immigration forms? Yes, eventually.
Get a full certified copy of the court papers from Korea before you leave.
As for your step-mother ... did she file immigration papers for you when you were young?
If she married your father before you were 18, she might still be possible to file.
An analysis is needed of the exact statutory language of the Korean law you broke. However, in general, DUI offenses do not trigger any statutory grounds of inadmissibilty. You will, however, have to disclose the conviction when asked--and failure to discuse the incident could have its own set of negative consequences.
