Urinalysis has been upheld unless you can show that they failed to follow proper procedures. I suggest you contact Attorney Tim Huey or John Saia if you are in the Columbus area. To be able to properly fight a DUI case with a urine test is very costly but well worth the effort. Good luck. www.becklawofficellc.com Ohio Criminal Defense and DUI Defense

Urinalysis is an accepted form of testing in Ohio. That being said, there are a number of ways to challenge the results of your specific urinalysis in court. There may potentially be error(s) made by the arresting officer in your case, specifically with respect to the time you took your test. There may also potentially be errors made in the collection, storing, transporting and testing of your urine specimen. The only way to know whether your test will stand up in court would be to go through and investigate all of those potential issues one by one. www.lawlh.com

Of the three methods of testing for alcohol, breath, blood and urine, I have found that urine testing is one that the police most often fail to follow the proper procedure and prosecutors have difficulty in demonstrating that the testing was properly done. I have found that urine testing is open to challenge when presented in court. You need to consult with and retain an experienced OMVI attorney to represent you. Good Luck.

To be admissible AT MINIMUM a urine sample must be taken within 3 hours from time of driving - and the officer must have reasonable grounds for the stop and probable cause for the arrest - and WHEN WE CHALLENGE THE RESULTS the prosecution must be able to show the testing "substantially complied" with the required rules and procedures -and must get all the right people in court to respond to our challenges. If they do that there are still questions whether the urine result is SCIENTIFICALLY reliable. I have had many urine cases in 27 years and have never had a case where the prosecution was able to jump all the hurdles we put in front of them.... I hope this helps answer you questions. Tim Huey
