My Wife is a US citizen and I'm an international student living and working in the US. We have applied for AOS as my wife filed form I-130 on my behalf. and I filed form I-485 based on marriage to a USC. I (The alien spouse) was previously issued an EAD card(Based on Post-completion OPT) which expires in December of 2012. I'm afraid I may not receive a renewed EAD card before expiration date/December 2012. In case if I didn't, can I continue working while waiting for my EAD card renewal approval or issuance? Can I continue working while my case/EAD is pending? Is is legal to do that? Is there a way of expediting the process? As a side note, I filed form I-765 for EAD 34 days before the expiration date for the current EAD card I have.

Generally speaking, you should never work if your EAD card is expired. Have you received your biometrics appointment yet? If you have not yet completed your biometrics appointment, you may want to see if you can do your biometrics as soon as you receive your appointment notice instead of waitiing for the actual appointment date. If your local biometrics office allows "walk ins" like this, it could save you a couple of weeks in getting your work card through the adjustment of status application.

If you begin with a new employer, you must have a current EAD. However, if you stay where you have been working it is not an issue. To expedite your case-- 1) info pass appointment and 3) contact your local congressman or senator Good Luck
