Anonymous6 views4 answers
I involved in a car accident and it was my fault but I didnt get any ticket or fine on my driver's license cause I just lost control on my car suddenly and I made the crash in a park area
still I cant believe it but It happened
Now an insurance company sent me a letter that my policy limit didnt cover the total expenses and they ask me to pay $3000 , this money is tooo much for me and I cant afford it
I even do not have any assets , I just work to survive hardly with my low income
What if they sue me ? IS that will affect my background check ?? cause I really dont have a penny to pay , What will happened to me if they sue me cause if that happened they will spend more money to lawyer and at the end I dont have a penny to pay , what can they do against me in my situation

The first thing to do is contact your insurance company and find out what the status of the claim against you is. If your insurance company pays any amount to settle the claim, it should require that the other insurance company or its insured execute a release of all claims that would relieve you of any further liability. If the other party or his insurance does not accept your insurance policy limit and sues you, your insurance company must provide a lawyer to defend you. At that point, he/she should communicate the fact that you are judgment proof and that it would be in their best financial interest to accept the policy limit and execute a release of all claims.
Good luck.
I agree with the prior responses. It sounds like you actually had insurance (you'd be amazed how many people don't these days), but your limits just were not enough to fix the other car. You really do need to contact your insurance company and make sure they have a copy of the letter you received, and find out if they have offered your property damage policy limits, and if so did they get a release of the claim.
I am not in your State but my respons is a little different from my fellow attorneys. When the insurance company, your insurance company, was evaluating the property damage portion of the loss, I believe you should have been informed of the policy limit issue. Where you ever informed of the policy limit issue by your insurance carrier? 2 years you will likely have to look back at your documentation. Your insurance carrier has an obligation to attempt to settle all cases within your policy limits. The insurance company may have breached its obligations to you if they did not. If you get sued and do not have any money then it will result in a judgment against you. At the end, if you do not have money to pay, they get a judgment against you. Talk to an atotorney in your State.
