Is my condo association responsible for storm related auto damage from fence?

A fence damaged my car during the recent storm. It appears to have come loose and it hit my car repeatedly causing scratches and dents. The fence surrounds the perimeter of my condo association's land. I believe that the fence is considered a common element.

I am not in your State but I believe you will find the answer to your question in the CC&R's. I would not say if something is or is not a common area until you read the CC&R's.

Even if it is a common area, you still need to prove negligence. The Condo's insurance carrier is likely going to tell you act of nature and deny the claim.
